Criminal Procedure: Exclusionary Rule: Exceptions

Exceptions to the exclusionary rule: The exclusionary rule does not apply to:
  • Grand Juries
  • Civil proceedings
  • Parole revocation proceedings
A good faith defense to exclusion of evidence exists when:
  • Police had a good faith reliance on a defective search warrant
  • Police had a good faith belief that a statute or ordinance was constitutional, though it was later ruled unconstitutional
  • Police had a good faith reliance on a judicial opinion, later changed by another opinion.
