Inducing a breach of contract = Δ is aware of a contract between the Π and someone else, and meddles in the bargain and ultimately persuades someone else to walk away from the bargain.
  • 1. Π must prove the elements of a valid K
  • 2. Δ must have knowledge of the K
  • 3. Δ must engage in persuasion/inducement convincing the 3rd party to breach.
  • 4. There must be a subsequent breach.
People who are in a special relationship with one of the contracting parties have a defense of privilege (a family member or a trusted advisor).
