Criminal Law: Defenses: Insanity

There are four separate tests for insanity (depending on the jurisdiction):

• M'Naughtn - D did not know the wrongfulness of his actions nor appreciate the nature and quality of them.

• Irresistible impulse - D lacked the ability to control his actions

• Durham - But for D's mental condition, the crime would not have occurred.

• ALI/MPC - D lacked the ability to conform his conduct to the requirements of the law.
